Terms of Service

By accessing or using Moodgrade, including the mobile applications (iOS and Android), the web application at moodgrade.com, and any related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

We may update these terms from time to time. Continued use of the service after changes are posted constitutes your acceptance of the updated terms. Material changes will be communicated through in-app notifications or email.

You must be at least 13 years old to use Moodgrade. If you are between 13 and 18, you represent that you have parental or guardian consent to use the service. Users in the EEA under 16 require parental consent in accordance with GDPR.

By creating an account, you represent that the information you provide is accurate and that you are authorized to use the email address associated with your account.

Moodgrade is a wellness tracker and journaling tool designed to help you reflect on your emotional patterns, sleep, habits, and medication adherence. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.

Moodgrade does not replace professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical or mental health condition.

If you are experiencing a mental health crisis, please contact your local emergency services or a crisis helpline immediately. The crisis resources available in the app are provided for informational purposes only.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@moodgrade.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms, are used for fraudulent purposes, or remain inactive for more than 24 months.

You retain full ownership of all content you create in Moodgrade, including mood entries, journal notes, medication records, and exported data. We do not claim any intellectual property rights over your content.

By using the sync feature, you grant Moodgrade a limited, non-exclusive license to store and process your content solely for the purpose of providing the service to you. This license terminates when you delete your content or your account.

You are solely responsible for the content you enter. Do not store sensitive information such as passwords, financial account numbers, or government identification numbers in your mood entries or journal notes.

Moodgrade offers optional premium access through monthly, yearly, and lifetime subscription plans. Subscriptions unlock features including unlimited history, advanced exports, AI-powered prompts, and an ad-free experience.

• Web subscriptions are processed through LemonSqueezy. Billing, renewal, and cancellation follow LemonSqueezy's terms and the plan you selected at checkout.
• Mobile subscriptions are managed through RevenueCat via the Apple App Store or Google Play Store. Billing and renewal follow the respective store's subscription terms.
• You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Refunds for web purchases follow LemonSqueezy's refund policy. Refunds for mobile purchases are handled by Apple or Google according to their respective policies.
• Lifetime subscriptions provide permanent premium access for as long as the Moodgrade service operates.

Moodgrade offers a free tier with core mood tracking, journaling, and basic insights. Free-tier users may see advertisements served by Google AdMob in the mobile app and Google AdSense on the web.

Free-tier limits include restricted history depth, a maximum number of habits, limited exports per month, and limited journal templates. These limits are subject to change with notice.

You agree not to use Moodgrade in any way that:

• Violates any applicable local, national, or international law or regulation
• Involves unauthorized access to, interference with, or disruption of the service or its infrastructure
• Involves automated scraping, crawling, or data extraction from the service
• Attempts to circumvent security controls, authentication mechanisms, or rate limits
• Involves impersonating another person or entity
• Introduces malicious code, viruses, or harmful data into the service

Your use of Moodgrade is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your data. By using the service, you consent to the data practices described in the Privacy Policy.

You can export your data at any time and delete your account and all associated server-side data through the app settings.

We strive to keep Moodgrade available and reliable, but we do not guarantee uninterrupted or error-free service. We may temporarily suspend the service for maintenance, updates, or unforeseen issues.

We reserve the right to modify, add, or remove features at any time. If we discontinue the service entirely, we will provide at least 30 days notice and ensure you can export your data before shutdown.

The Moodgrade name, logo, design, code, and all associated intellectual property are owned by Yusuf Ihsan Gorgel. You may not copy, modify, distribute, or reverse-engineer any part of the service without prior written permission.

Third-party libraries and services used in Moodgrade retain their respective licenses and ownership.

To the maximum extent permitted by applicable law, Moodgrade and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.

Our total liability for any claim arising from or related to the service shall not exceed the amount you have paid for Moodgrade in the 12 months preceding the claim, or 50 EUR, whichever is greater.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Moodgrade is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will meet your specific requirements, that insights or statistics will be accurate or complete, or that the service will be available without interruption.

You agree to indemnify and hold harmless Moodgrade and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these terms or your misuse of the service.

These terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these terms or the service shall be resolved in the courts of Istanbul, Turkey.

For users in the European Union, nothing in these terms affects your rights under mandatory consumer protection laws in your country of residence.

You may stop using Moodgrade at any time by deleting your account through the app settings. We may terminate or suspend your account if you violate these terms.

Upon termination, your right to use the service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
